6. SMS Program

Individuals who provide affirmative consent to receive SMS messages from Law Office of Samuel Reyes PLLC may receive conversational, customer-care, informational, appointment, scheduling, and legal-service-related text messages from the Firm.

Depending upon the individual's relationship with the Firm, messages may concern:

  • Consultation requests;

  • Consultation confirmations;

  • Appointment confirmations and reminders;

  • Appointment changes;

  • Court, hearing, mediation, deposition, or other scheduling information;

The Firm should only include categories here that correspond with the use cases ultimately submitted in the RingCentral registration. RingCentral expressly requires the SMS messages actually transmitted to correspond with the registered use cases.

7. Consent to Receive SMS Messages

Consent to receive SMS messages is voluntary.

Providing a telephone number to the Firm does not, standing alone, constitute consent to receive SMS messages where affirmative consent is otherwise required.

Where applicable, the Firm will request permission to communicate by SMS through an appropriate consent mechanism.

Consent to receive SMS messages is not a condition of purchasing legal services or retaining the Firm.

RingCentral's current guidance requires businesses to obtain consent before initiating SMS communications and specifically provides consent procedures for web forms, verbal consent, email consent, written forms, and circumstances in which the consumer initiates the text conversation.

8. Message Frequency

Message frequency may vary.

The number and frequency of messages will depend upon the recipient's communications with the Firm, scheduled events, the nature of the legal matter, and the services requested.

9. Message and Data Rates

Message and data rates may apply.

Charges imposed by a recipient's mobile carrier are solely governed by the recipient's wireless-service agreement.

10. Opting Out — STOP

A recipient may discontinue SMS communications from the Firm at any time by replying:

to a message received from the Firm.

RingCentral also recognizes certain equivalent opt-out commands, but STOP is the standard instruction that should be disclosed to recipients. After an opt-out is processed, RingCentral restricts further outbound messages from that registered number to the opted-out recipient.

12. Re-Enrollment

A person who has previously opted out should not be sent additional SMS messages unless the person subsequently provides appropriate consent to resume SMS communications.

RingCentral presently recognizes START and certain equivalent commands for resuming communications following an opt-out.

13. No Guarantee of Delivery

SMS transmission is dependent upon telecommunications networks and mobile carriers outside the Firm's control. Accordingly, the Firm cannot guarantee that every text message will be delivered or received immediately.

SMS should not be relied upon as the sole method of communicating an emergency, filing deadline, court deadline, or other matter requiring immediate action.

14. Security

The Firm uses reasonable administrative, organizational, and technical measures intended to protect personal information within its custody or control.

Nevertheless, no electronic transmission, internet service, email system, website, or telecommunications system can be guaranteed to be completely secure.

Users should exercise appropriate care when transmitting confidential or sensitive information electronically.
